These Terms of Service (“Terms”) govern your access to and use of Kloned.ai (the “Service”), operated by Maesto LLC, a California limited liability company (“we”, “us”, or “our”). By accessing or using Kloned.ai, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
Overview of the Service
Kloned.ai provides AI-powered tools that allow users to:
• Upload photos and generate AI images, portraits, and likeness-based content (“Image Generation”);
• Create and use voice clones based on user-provided recordings (“Voice Cloning”);
• Generate talking photo or video content using images and audio (“Talking Photo Generation”);
• Access other creative AI features as we may release from time to time.
All content generated by the Service (collectively, “Generated Content”) is created using machine learning models that analyze input data provided by the user.
Eligibility
You must be at least 18 years old to use the Service. If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
User Accounts
You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.
Uploads and User Input
By uploading or submitting any photos, audio, or other content (“User Input”) to the Service, you confirm that:
• You own or have full rights and permissions to use and upload the material;
• The material does not infringe on any third-party rights, including privacy, publicity, or intellectual property rights;
• The material does not contain explicit, abusive, or illegal content.
You grant Maesto LLC a non-exclusive, worldwide, royalty-free license to process, reproduce, and use your User Input solely for:
1. Providing and improving the Service;
2. Generating the requested outputs (e.g., AI images, videos, voice content); and
3. Fulfilling customer support, analytics, and operational purposes.
Your User Input will not be used to retrain our models in a way that could reproduce or expose your likeness or voice for other users.
Ownership and Usage Rights
a. Your Rights
You retain ownership of all photos, audio, and materials you upload.
You also own the Generated Content produced from your inputs, to the extent permitted by law.
You are free to use, share, and commercialize your Generated Content, provided that your use complies with these Terms and applicable law.
b. Our Rights
We retain ownership of the Service, underlying technology, and AI models.
We reserve the right to use anonymous and aggregated data for research, product improvement, and statistical purposes.
Prohibited Uses
You agree not to use the Service for any of the following:
• Creating deepfakes or likeness-based content of any person without their consent;
• Generating pornographic, obscene, defamatory, or discriminatory material;
• Impersonating others or engaging in harassment, fraud, or deception;
• Violating privacy, publicity, or intellectual property rights;
• Attempting to reverse engineer, extract data, or misuse our models or infrastructure.
Violation of this section may result in immediate suspension or permanent account termination, without refund.
Voice Cloning Specific Terms
If you use the Voice Cloning feature:
• You must upload only your own voice or the voice of someone who has given you explicit written consent.
• You may not upload, replicate, or use celebrity voices or the voices of other individuals without consent.
• Generated voices may not be used for any unlawful or misleading purposes, including impersonation, fraud, or misrepresentation.
Maesto LLC disclaims any liability for misuse of voice cloning or AI-generated speech content by users.
Talking Photo / Video Generation
When you use image + audio to create talking videos:
• You must ensure that the photo and voice belong to you or that you have the necessary rights to use them together.
• You may not create or distribute realistic talking videos of others without consent.
• All generated talking media must comply with laws regarding impersonation, defamation, and privacy.
Payments and Credits
Kloned.ai operates on a credit-based system.
• Credits may be purchased as part of a package, subscription, or one-time offer.
• Credits are non-refundable, non-transferable, and expire as stated at purchase.
• We may offer promotional or bonus credits that carry specific limitations or expiration dates.
All prices are listed in U.S. dollars and subject to change at any time. Payment processing is handled through secure third-party providers.
Refund Policy
Due to the digital nature of AI-generated content, all sales on Kloned.ai are final once content generation has begun. You are given the opportunity to review generated previews before downloading. By downloading or accessing your generated content, you acknowledge satisfaction with the results and waive your right to request a refund.
Refunds are not provided for additional credit purchases or any subsequent top-ups made after your initial order, regardless of whether those credits have been used.
If your generated files are corrupted, incomplete, or fail to render due to a system error, please contact our support team within 7 days of purchase at support@kloned.ai. Refunds or credit adjustments may be issued at our sole discretion in such cases.
Privacy

By using the Service, you consent to our data practices as described there.
Service Availability
We strive to maintain continuous access to Kloned.ai but do not guarantee uninterrupted or error-free operation.
We may temporarily suspend or limit access for maintenance, updates, or technical reasons without notice.
Disclaimer of Warranties
The Service and all Generated Content are provided “as is” and “as available” without warranties of any kind.
We make no guarantees about the accuracy, realism, or suitability of AI-generated results for any purpose.
Maesto LLC expressly disclaims any responsibility for damages resulting from the use or misuse of the Service, including the publication or distribution of Generated Content.
Limitation of Liability
To the fullest extent permitted by law, Maesto LLC and its affiliates, officers, employees, and contractors shall not be liable for:
• Any indirect, incidental, special, or consequential damages;
• Loss of profits, reputation, or data;
• Any claim related to your use of or inability to use the Service.
Our total liability under any claim shall not exceed the total amount paid by you for the Service in the 3 months preceding the claim.
Indemnification
You agree to defend, indemnify, and hold harmless Maesto LLC from any claim, demand, or expense (including attorneys’ fees) arising out of:
• Your use of the Service;
• Your violation of these Terms; or
• Your Generated Content or misuse of likeness/voice content.
Termination
We may suspend or terminate your access at any time if we believe you violated these Terms, applicable law, or engaged in behavior that harms others or our business.
Upon termination, all rights granted to you under these Terms shall immediately cease.
Modifications to the Terms
We may update these Terms from time to time.
The latest version will always be posted on this page with a “last updated” date.
Your continued use of the Service after any update constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.
Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in San Diego County, California.
